By accessing or using this Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Site.
Please read these Terms carefully before using the Site. These Terms apply to all visitors, users, and others who access or use the Site.
Acceptance of Terms
By accessing or using this Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree to these Terms, you are not authorized to access or use this Site.
We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.
Use of the Website
You may use this Site only for lawful purposes and in accordance with these Terms. You agree not to:

You may not reproduce, modify, distribute, or publicly display any downloaded content without prior written permission from eLUXE3D.

Shopping Cart and Transactions
If the Site offers the ability to purchase products or services, you agree to provide accurate, complete, and current information for all purchases made through the Site, including billing and contact details.
By submitting a purchase, you authorize eLUXE3D or its third-party payment processor to charge the full amount to your selected payment method. All transactions are subject to verification and approval before fulfillment.

To the fullest extent permitted by law, eLUXE3D disclaims all warranties, express or implied, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties related to the accuracy, reliability, or completeness of any content
- Warranties that the Site will be uninterrupted, secure, error-free, or free of viruses or other harmful components
Use of the Site is at your own risk. We do not guarantee that any errors or defects will be corrected.
Limitation of Liability
To the maximum extent permitted by law, eLUXE3D and its officers, directors, employees, agents, affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Site or any products or services offered through it.
This includes, but is not limited to, damages for loss of profits, data, goodwill, business interruption, or other intangible losses—even if we have been advised of the possibility of such damages.
In jurisdictions that do not allow certain limitations of liability, our liability shall be limited to the fullest extent permitted by applicable law.
To the maximum extent permitted by law, eLUXE3D’s total liability arising from a product or service will not exceed the amount paid for the product or service giving rise to the claim. This limitation does not apply to liability that cannot lawfully be limited or to rights available under applicable consumer law.
Indemnification
You agree to indemnify, defend, and hold harmless eLUXE3D, its affiliates, officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses—including reasonable legal fees—arising out of or in connection with:
- Your use of or access to the Site
- Your violation of these Terms
- Your infringement of any intellectual property or other rights of any third party
- Any content or data you submit to the Site
This obligation survives the termination of these Terms and your use of the Site.
To the extent permitted by law, this indemnification also applies to third-party claims arising from unsafe handling of products or modification or combination of products not authorized by eLUXE3D. This section does not require a consumer to indemnify eLUXE3D for eLUXE3D’s own negligence or misconduct where prohibited by law.
Governing Law
These Terms and any disputes arising out of or relating to your use of the Site shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict of law principles.
You agree that any legal action or proceeding arising under or in connection with these Terms shall be brought exclusively in the state or federal courts located in Oakland County, Michigan, and you hereby consent to the personal jurisdiction and venue of such courts.
The United Nations Convention on Contracts for the International Sale of Goods does not apply. Nothing in this section limits non-waivable rights under applicable consumer law.
Changes to These Terms
We may update or modify these Terms and Conditions at any time, at our sole discretion. Any changes will be effective immediately upon posting the revised version on this page, unless otherwise stated.
It is your responsibility to review these Terms periodically. Your continued use of the Site after any modifications indicates your acceptance of the updated Terms.
Changes may apply prospectively unless otherwise permitted by law. Material changes affecting paid or ongoing services will be handled in accordance with the applicable agreement and law.
Scope, Eligibility and Order of Precedence
These Terms also govern eLUXE3D online forms and portals, quotations, orders, 3D scanners, scan spray, accessories, software, training, support, installation, repair, and related services.
You must be at least 18 years old and legally able to enter into a contract. If you act for a company or other organization, you represent that you have authority to bind that organization. eLUXE3D scanners, software, scan spray, and related services are designed primarily for professional, commercial, educational, or industrial use.
A signed quotation, order form, reseller agreement, subscription agreement, software license, warranty, statement of work, or other written agreement may contain additional or different terms. If there is a conflict, the following order controls: (1) a signed written agreement or order form; (2) the applicable product warranty or software license; (3) the applicable Refund and Return Policy; and (4) these Terms.
Quotes, Orders, Pricing, Payment, Taxes and Collection
A quote is an invitation to place an order and may expire on the date stated. An order is accepted only when eLUXE3D issues written confirmation, accepts payment, ships the product, or otherwise begins performance.
We may reject or cancel an order for pricing errors, suspected fraud, export restrictions, product unavailability, credit concerns, or other legitimate business reasons. If we cancel after payment, we will refund the applicable amount. Customer-requested cancellations are governed by the applicable Refund and Return Policy and any signed order terms.
Prices are stated in the currency shown and exclude taxes, duties, brokerage, shipping, insurance, installation, and other charges unless expressly included. You are responsible for applicable sales, use, value-added, import, customs, and similar taxes, except taxes based on eLUXE3D’s net income.
Payment is due as stated in the applicable quote, invoice, checkout page, or other order terms. Overdue business accounts may be subject to the lesser of 1.5% per month or the maximum lawful rate, plus reasonable collection costs. You may not withhold or offset amounts unless required by law or agreed in writing.
Shipping, Delivery, Inspection and Risk of Loss
Delivery dates are estimates unless expressly guaranteed in writing. Shipping terms, title, and risk of loss are determined by the applicable quote, order confirmation, or shipping term.
If no term is stated, risk of loss passes to the Customer when the product is delivered to the carrier, except where applicable law requires otherwise. The Customer must inspect shipments promptly and report visible shipping damage, shortages, or incorrect items within five business days, preserving packaging and documentation for carrier claims.
Installation, Environment and Customer Responsibilities
Unless otherwise agreed, the Customer is responsible for providing compatible computer hardware, operating systems, electrical power, network access, workspace, environmental conditions, trained personnel, and any third-party software required for operation.
Scanner performance depends on the object, surface characteristics, preparation, spray application, calibration, operator technique, computer configuration, and downstream software. The Customer must follow eLUXE3D instructions and applicable safety data sheets.
Software and License Restrictions
Software, firmware, documentation, and digital content are licensed, not sold, and are subject to the applicable license terms.
Unless expressly permitted, you may not copy, modify, reverse engineer, decompile, disassemble, circumvent license controls, sublicense, rent, lease, resell, publish, or use software to develop or benchmark a competing product. You may not remove proprietary notices. Updates may be required for security, compatibility, or continued service.
Training, Support, Maintenance and Remote Access
Training, support, maintenance, warranty, and software updates are provided only as stated in the applicable product package or agreement.
Support may require remote-access tools, diagnostic logs, images, scan files, or system information. The Customer authorizes such access only for the requested support session and remains responsible for maintaining backups and protecting unrelated confidential information.
eLUXE3D may refuse support for unsupported modifications, misuse, unauthorized repairs, incompatible third-party products, or accounts that are not current.
Customer Content and Scan Data
You retain ownership of files, images, CAD data, 3D scans, comments, and other content you submit (“Customer Content”).
For Customer Content submitted for products, demonstrations, support, training, troubleshooting, or services, you grant eLUXE3D a limited, non-exclusive license to host, copy, process, transmit, and use that Customer Content as reasonably necessary to provide the requested service. You represent that you have all rights and permissions necessary to provide Customer Content and that it does not infringe intellectual property, privacy, confidentiality, export-control, or other rights. Additional confidentiality obligations may be stated in a separate agreement.
Product Safety and Scan Spray
You must review product labels, instructions, and safety data sheets before using scan spray or other consumables. Use products only in well-ventilated areas and with appropriate personal protective equipment and storage practices.
Scan spray is not intended for ingestion, skin application, use on living persons or animals, or use in a manner inconsistent with its label. The Customer is responsible for determining material compatibility and protecting valuable objects from residue, discoloration, or damage. Always test on an inconspicuous area when appropriate.
Product Specifications, Results and Limited Warranties
Published accuracy, resolution, scan time, and workflow results are based on specified methods and conditions and may vary. eLUXE3D does not guarantee that every object can be scanned, that scan data will be error-free, or that results will be suitable for a particular CAD, manufacturing, inspection, appraisal, gemological, medical, safety-critical, or regulatory purpose.
The Customer is responsible for validation, measurement strategy, downstream design decisions, manufacturing tolerances, and final quality control.
Products are covered only by the written limited warranty, if any, provided with the product or order. The warranty may require registration, proof of purchase, proper installation, approved use, and return authorization. Unless expressly stated, warranties do not cover consumables, normal wear, cosmetic damage, contamination, accidents, misuse, improper storage, unauthorized repairs, third-party products, power events, incompatible systems, modifications, or failure to follow instructions. Defective products are handled under the applicable warranty and Refund and Return Policy.
Privacy and Electronic Communications
Our Privacy Policy explains how we handle personal information. By providing contact information, you consent to receive transactional communications related to inquiries, quotes, orders, accounts, warranties, and support.
Marketing communications are subject to applicable law and your opt-out choices. Electronic records, signatures, and communications may be used to the extent permitted by law.
Returns, Refunds, Exchanges and Cancellations
Eligible direct purchases from eLUXE3D may be returned when the return requirements below are satisfied. Purchases from an authorized reseller are subject to that reseller’s policy unless eLUXE3D agrees otherwise in writing.
Return Window and Authorization
To be eligible for a discretionary return, you must contact eLUXE3D and request a Return Merchandise Authorization (“RMA”) within 14 calendar days after the carrier records delivery. After an RMA is issued, the product must be shipped within seven calendar days using the instructions provided. Products sent without an RMA may be refused or returned to sender.
How to Request a Return
- Email support@eluxe3d.com with the order or invoice number, purchaser name, product and serial number if applicable, delivery date, and reason for return.
- Wait for written approval and an RMA number. eLUXE3D may request photos, diagnostic information, or a support session before authorizing a scanner return.
- Package the product exactly as instructed, include the RMA number, and ship it with tracking and adequate insurance.
- Do not send scan spray or other regulated shipping materials by air or by a carrier that does not accept the product. Follow all label, carrier, and hazardous-material shipping requirements.
3D Scanner Returns
A scanner must be returned in like-new condition, free from damage, contamination, alteration, unauthorized repair, excessive wear, or misuse, with all cameras, turntables, fixtures, cables, calibration items, accessories, manuals, license materials, security devices, promotional items, and original packaging. Serial numbers and product labels must be intact, and any included software license, account entitlement, or device activation must be capable of deactivation or transfer back to eLUXE3D. Custom-built, specially configured, engraved, modified, final-sale, or otherwise return-restricted products may be ineligible.
Unopened scanners returned in their original sealed shipping condition are not subject to an open-box restocking fee. An opened scanner that otherwise qualifies may be subject to a restocking fee of up to 15% of the product purchase price. Missing items, damage, contamination, or excessive use may result in additional reasonable deductions. If the product cannot be restored to saleable condition, the return may be rejected.
3D Scan Spray and Consumables
Scan spray and similar consumables may be returned within 14 calendar days after delivery only if unopened, unused, in the original sealed container and packaging, and in resalable condition. Opened, used, partially used, punctured, leaking, damaged after delivery, improperly stored, or expired consumables are not returnable, except when defective when delivered, damaged in transit, or not the product ordered. Do not ship scan spray without eLUXE3D’s written return instructions.
Damaged, Defective, or Incorrect Products
Report visible shipping damage, leakage, shortages, or incorrect items within five business days after delivery. Include photographs of the shipping carton, label, packaging, and product, and keep all packaging until the claim is resolved. If eLUXE3D confirms that a product was defective when delivered, damaged in transit, or shipped incorrectly, eLUXE3D will provide an appropriate remedy, which may include replacement, repair, return shipping, or refund. Scanner defects discovered after the 14-day return window are handled under the applicable written limited warranty.
Non-Refundable Products and Charges
- Opened or used scan spray and other consumables, except for confirmed defects, shipping damage, or incorrect fulfillment
- Activated or delivered software licenses, subscriptions, digital downloads, or license renewals, except where a separate agreement states otherwise
- Completed or partially completed training, installation, travel, shipping, expedited delivery, CAD, scanning, consulting, repair, calibration, or professional services
- Custom, special-order, modified, engraved, bundled, promotional, clearance, demonstration, refurbished, or final-sale products when identified as non-returnable at purchase
- Import duties, customs charges, brokerage fees, taxes remitted to a government, foreign-exchange losses, and third-party financing or payment fees, except where refundable by the applicable authority or provider
- Products damaged by improper packaging, improper return shipping, accident, misuse, unauthorized repair, contamination, failure to follow instructions, or circumstances arising after delivery
Return Shipping, Inspection and Refund Processing
For a discretionary or buyer’s-remorse return, the Customer is responsible for packing, return shipping, tracking, insurance, duties, and carrier charges. Original shipping and handling charges are non-refundable. For a confirmed defective, damaged-in-transit, or incorrect item, eLUXE3D will provide reasonable return instructions and, when appropriate, a prepaid label or reimbursement. Risk of loss remains with the Customer until the return is received and accepted by eLUXE3D.
All returns are inspected and, for scanners, may be tested and recalibrated. Approved refunds are issued to the original payment method within 10 business days after inspection and acceptance. Banks, card issuers, financing providers, and payment processors may require additional time to post the credit. If the original payment method is unavailable, eLUXE3D may issue another lawful form of refund after verifying the purchaser.
Exchanges, Cancellations, International Returns and Payment Disputes
eLUXE3D may offer an exchange instead of a refund when requested and replacement inventory is available. Any price difference, shipping charge, tax, or duty must be paid before the replacement ships. An exchange does not restart the original 14-day return period unless eLUXE3D states otherwise in writing.
Contact eLUXE3D immediately to request cancellation. An order may be cancelled without a product restocking fee if it has not been processed, configured, licensed, packed, or shipped and no nonrecoverable costs have been incurred. After processing or shipment begins, the order is subject to these return terms. Custom and special-order products may not be cancellable after work begins.
International customers must obtain an RMA and follow customs instructions before shipping. The Customer is responsible for export documents, return authorization, duties, taxes, brokerage, and compliance with carrier and dangerous-goods rules unless the return is caused by eLUXE3D’s confirmed error or a covered defect.
Please contact eLUXE3D before initiating a chargeback so we can attempt to resolve the issue. Filing a chargeback does not eliminate obligations under an accepted order or return requirements. eLUXE3D may provide the payment provider with the order, delivery, support, RMA, and policy records relevant to the dispute.
These return terms provide contractual return rights in addition to any non-waivable rights under applicable law. Nothing in this section limits remedies for products that are defective, materially misrepresented, or covered by an applicable written warranty. If a signed quote, order form, reseller agreement, or other written contract provides different return terms, that document controls for the applicable purchase.
Export Controls and Sanctions
Products, software, technical information, and services may be subject to United States export-control and sanctions laws. You may not export, re-export, transfer, release, or use them in prohibited countries, for prohibited end users, or for prohibited end uses. You agree to provide accurate end-use and destination information and obtain required authorizations.
Force Majeure
eLUXE3D is not liable for delay or failure caused by events beyond reasonable control, including natural disasters, fire, epidemic, war, terrorism, civil unrest, labor disputes, carrier delays, shortages, cyber incidents, utility or internet failures, government actions, export restrictions, or supplier failures. Performance will resume as reasonably practicable.
Suspension and Termination
We may suspend or terminate access to the Site, portals, software, support, or services for material breach, nonpayment, security risk, unlawful activity, misuse, or as otherwise permitted by an applicable agreement.
Provisions that by their nature should survive termination will survive, including payment, intellectual property, disclaimers, liability limitations, indemnity, and dispute terms.
General Provisions
If any provision is held unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver.
You may not assign these Terms without our written consent; eLUXE3D may assign them in connection with a merger, reorganization, financing, sale of assets, or transfer of the applicable business. Headings are for convenience only.
These Terms, together with incorporated policies and applicable order documents, are the entire agreement regarding their subject matter.
